Published: Feb. 1, 2014 | Result Date: Jan. 8, 2014 | Filing Date: Jan. 1, 1900 |

Case number: 3:12-cv-00911-H-WMC Bench Decision –  Preliminary Injunction Denied

Facts

Peregrine Semiconductor Corp. owned several patents, including United States Patent No. 7,910,933, No. 7,123,898, No. 7,460,852, No. 7,796,969, and No. 7, 860,499. The various patents all covered advanced integrated circuit technologies for use in radio frequency circuits. These circuits could be used for a wide variety of purposes, including antenna-tuning circuits.

Peregrine filed suit against RF Micro Devices Inc., alleging that it had infringed on these patents.

Contentions

PLAINTIFF'S CONTENTIONS:
Peregrine claimed that RF infringed on each of the five patents, by making products that used certain integrated circuits covered by the patents. Peregrine moved for a preliminary injunction against RF, preventing it from continuing to infringe.

DEFENDANT'S CONTENTIONS:
RF denied infringing upon the patents, and asserted various affirmative defenses.

Result

The court denied Peregrine's request for a preliminary injunction, finding that Peregrine had not proven that an injunction was warranted.
