Facts
On Feb. 20, 2012, Peter Borodin rode his motorcycle on Franklin St. in San Francisco. Robert Lara, who worked for Vickers Concrete Sawing Inc., was driving Vickers' vehicle on Hickory St. The two vehicles were involved in a collision at the intersection of the two streets. Borodin sued Lara and Vickers. Later, Lara was taken out of the lawsuit.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that Lara hit his motorcycle and drove in a negligent manner. Also, plaintiff claimed Vickers negligently allowed him to drive its vehicle and should be liable for his conduct. Specifically, plaintiff argued Lara drove from an alleyway and tried to unlawfully drive through several traffic lanes, although he could only legally turn left based on a sign at the intersection.
Damages
Borodin asked for pain and suffering damages, medical expenses, and lost income in the future.
Injuries
Plaintiff suffered fractures to his fibula and tibia, and leg necrosis. He had to receive six surgeries.
Result
Vickers and Borodin reached a $3 million settlement.
