Facts

The Federal Trade Commission filed an administrative complaint against BitTorrent Inc., based on alleged violations of the FTC Act. BitTorrent was the developer of a peer-to-peer file-sharing system used to exchange computer files.

Contentions

PLAINTIFF'S CONTENTIONS:
In January 2007, BitTorrent submitted a self-certification of compliance with the U.S.-EU Safe Harbor Framework. However, it later failed to renew its self-certification, but claimed to still be in compliance.

Result

BitTorrent was prohibited from making further misrepresentations about its compliance with the U.S.-EU Safe Harbor Framework, and to make all of its advertisements and promotional materials containing representations covered by the order available to the FTC for a period of 5 years.
