Facts

On Aug. 28, 2005, at about 1:17 a.m., plaintiff Morales and defendant Yatso were riding in a vehicle. The defendant was driving at an unsafe speed for existing roadway conditions. As a result, the vehicle went off the side of the road and struck a pole. The plaintiff was injured in the collision.

The plaintiff contended that the defendant was driving too fast.

The defendant admitted liability.

Settlement Discussions

The demand was for $250,000, the policy limit. The offer was for $250,000, the policy limit.

Damages

The claimed medical liens totaled $7,855.30.

Injuries

Plaintiff sustained a broken left arm.
