Facts
George Robinson, a prisoner at Corcoran State Prison, claimed that a correctional official at Calipatria State Prison, William Price, punched him repeatedly and choked him on Nov. 16, 1999 while he was at Calipatria. Robinson filed a complaint against Price and also named Shane Baker, Martin Jimenez and Phillip Zills as defendants for their failure to intervene.
No weapons were used during the incident and the plaintiff had no visible physical injuries. The plaintiff also bit Price's fingers and kneed him, according to defense counsel.
Contentions
PLAINTIFF'S CONTENTIONS:
Violation of Civil Rights based on allegations of excessive force.
DEFENDANT'S CONTENTIONS:
Defendants denied plaintiff's allegations and testified Price did not punch or choke plaintiff. Defendants contended they used minimal force to restrain plaintiff, who was assaultive and resistive. Plaintiff was medically evaluated and medical staff were unable to discern any injuries even in days following the incident.
Settlement Discussions
The plaintiff demanded $50,000 and the defendants offered a waiver of costs.
Damages
The plaintiff sought compensatory damages in the amount of $500,000 and punitive damages in the amount of $100,000. The plaintiff sought $30,000 for each defendant.
Injuries
The plaintiff claimed he suffered bruises and scratches to his body, as well as emotional distress.
