PLAINTIFF'S CONTENTIONS:
Solis alleged violations of the Fair Labor Standards Act. Solis further alleged failure to disgorge ill-gotten gains due to employees.
DEFENDANT'S CONTENTIONS:
Defendant contended that they were unaware of the failure of their independent contractor to pay the contractor's employees, for wages allegedly incurred in the manufacture of garments sold by Monteau. Defendant contended that the alleged ill-gotten gains arising from the manufacture and sale of the garments were due to employees of the independent contractor.
Result
The parties reached a settlement for $100,890.
