In August 2006, plaintiff Armen Garibyan visited his friend defendant Edik Sakouyan in Portland, Ore. Sakouyan owned an engine remanufacturing business. After Garibyan returned to Sun Valley, California, he deposited money into Sakouyan's bank account and Sakouyan subsequently sent some of his business equipment to Garibyan. This occurred three times and Garibyan paid for all shipping charges. The equipment that Sakouyan shipped to Garibyan remained unwrapped in Garibyan's warehouse.
Contentions
PLAINTIFF'S CONTENTIONS:
Garibyan contended that he was merely storing Sakouyan's equipment until Sakouyan could get his finances in order. Garibyan argued that he was merely helping a friend in financial distress.
DEFENDANT'S CONTENTIONS:
Sakouyan contended that Garibyan's payments represented installments in a $150,000 purchase agreement.
Damages
Garibyan suffered damages in the amount of $5,845 in shipping costs; $15,600 in storage fees; and $19,500 in unpaid loans.
Result
The court found in favor of Garibyan in the amount of $25,870. This amount of damages represented $6,370 for shipping costs and $19,500 for unpaid loans.
