Facts

Defendant Kimberly Bakker borrowed plaintiff Jewelry by Rosalina's original $55,000 Rosalina bracelet to wear to the San Francisco Symphony opening night in September 2007. Bakker then wore it several days later to the Jersey Boys cast party and lost it.

Contentions

PLAINTIFF'S CONTENTIONS:
The plaintiff contended that defendant should have returned the bracelet after the symphony. She should have safeguarded the bracelet after it allegedly fell off her wrist several times.

DEFENDANT'S CONTENTIONS:
Defendant contended that the bracelet was defective because it "kept falling off" her wrist and she should not be liable for the loss.

Settlement Discussions

The plaintiff made a C.C.P. section 998 offer to compromise for $55,000, which was not accepted.

Result

Verdict for $63,954 with prejudgment interest.
