In September 2003, plaintiff Sammy Espinoza was driving in Fresno when defendant LaVonne Aldag rear-ended him. The plaintiff sued, alleging negligent operation of a motor vehicle. The defendant conceded liability, but argued that because there was minimal impact, she barely touched plaintiff's vehicle.
