On Aug. 11, 1994, claimant Candace Wedlan, a 45-year-old news editor, went to an automobile dealer with a friend to purchase a car. While the claimant was on the lot looking at vehicles, an employee of the dealer backed a vehicle out and the rear tire ran over the claimant's foot, causing injury. The dealer's carrier was insolvent. The claimant brought an uninsured motorist claim against the respondent carrier.
