Facts

Elizabeth Salazar filed a wage and hour purported class action against Goldstar Healthcare LLC, Goldstar Healthcare Center of Santa Monica, LLC and Goldstar Healthcare Center of Inglewood, LLC on behalf of herself and a putative class of individuals employed by the defendants as Certified Nurse Assistants (CNAs). The complaint alleged six causes of action, including failure to pay wages, failure to pay premium wages for unprovided meal and rest periods, and derivative claims for failure to provide accurate wage statements, failure to timely pay wages due upon termination of employment, and unfair business practices.

Defendants denied all of plaintiff's allegations and asserted that they had complied with all applicable labor laws. During the pendency of the litigation, the legal standards applicable to several of plaintiff's claims, including the scope of defendants' obligation to provide meal and rest breaks, were on appeal to the California Supreme Court.

Result

The parties agreed to a class-wide settlement in the amount of $75,000, which obtained final court approval on November 15, 2012.
