On Aug. 7, 2008, Sandra Alarcon was driving her sport utility vehicle in Los Angeles. A head-on collision with a vehicle driven by Judith Sollott occurred, totaling both of their vehicles. Alarcon filed suit against Sollott. Sollott died for reasons unrelated to this incident, and Howard Learner replaced her in the lawsuit as executor of her estate. Next, the dispute was taken to arbitration.

Plaintiff alleged defendant negligently operated her vehicle because she was driving on the wrong side of the road.
