Facts

On Aug. 7, 2008, Sandra Alarcon was driving her sport utility vehicle in Los Angeles. A head-on collision with a vehicle driven by Judith Sollott occurred, totaling both of their vehicles. Alarcon filed suit against Sollott. Sollott died for reasons unrelated to this incident, and Howard Learner replaced her in the lawsuit as executor of her estate. Next, the dispute was taken to arbitration.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff alleged defendant negligently operated her vehicle because she was driving on the wrong side of the road.

DEFENDANT'S CONTENTIONS:
Defendant's estate did not dispute responsibility.

Damages

Plaintiff asked for $38,205 in past medical costs, $3,000 in future medical costs, $9,000 for loss of use of her car, and $1,000 for a paid deductible under her insurance policy.

Injuries

Alarcon suffered injuries to her neck, back, abdomen, foot, and hand.

Result

The arbitrator awarded Alarcon $83,105.
