Facts

The freeway entrance from Arrow Highway in San Dimas to the 57 north freeway has a carpool lane that is not controlled by a traffic signal and another lane that has a meter light. On April 15, 2004, at 8:30 a.m., defendant Robert Sloggett was driving a 2000 Peterbilt 3-axle flatbed truck, which was owned by defendant Dallas Mavis. Sloggett's vehicle was in both lanes while waiting for a green light. Once the light became green, Sloggett moved forward and then drove left to maneuver a quick right turn on to the freeway. Prior to reaching the left curb on the freeway ramp, he glanced in his mirror and realized he had hit plaintiff's vehicle, a 1999 Dodge Intrepid.

Contentions

PLAINTIFF'S CONTENTIONS:
The plaintiff asserted that she was driving behind Sloggett, who was illegally using the carpool lane. She tried to pass Sloggett on his right, but was forced to stop for the on-ramp signal. While she was stopped, Sloggett's trailer hit her vehicle.

DEFENDANTS' CONTENTIONS:
The defendants claimed that plaintiff did not disclose any injuries at the time of the accident. Defendants thought the collision was minor.

Damages

$36,535 for medical expenses.

Injuries

The plaintiff claimed that she suffered hip injuries. She also claimed lower and middle back pain, which required chiropractic attention and eventually a spinal fusion.

Result

The jury concluded that the defendants were negligent, however their negligence did not cause plaintiff's injuries. Thus, jury returned a defense verdict.
