Facts

On July 1, 2005, plaintiff Pervies Ary was handcuffed and temporarily detained when he refused to cooperate with defendant Los Angeles County Sheriff's Deputies on patrol in the Crystal Park Casino parking lot in Compton. The plaintiff sued defendant county of Los Angeles for violation of his civil rights.

Contentions

PLAINTIFF'S CONTENTIONS:
The plaintiff contended defendants falsely arrested him and used excessive force to detain him, causing a shoulder injury. He was later released without being cited or arrested.

DEFENDANTS' CONTENTIONS:
The defendants contended LACMTA passengers had been the victims of criminal activity, so deputies were conducting a routine investigation in a high-crime area. The plaintiff was hostile to them, unlike the driver, who immediately complied with commands to exit the car. Further, defendants did not use any force other than to handcuff plaintiff.

Injuries

The plaintiff suffered a shoulder injury.

Result

The parties reached a settlement for $70,000.
