Facts

Plaintiff Janice Weissman, as a passenger in a vehicle driven by her husband, was involved in a two-vehicle accident on Sept. 4, 2005. Both vehicles sustained moderate damages. For purposes of the mediation, defendants conceded to liability.

Settlement Discussions

Prior to the commencement of the mediation, defendants, through their insurance carrier, Farmers Insurance Group, offered $33,058. The plaintiff demanded $85,000, although she filed and served a policy limit demand, under C.C.P. section 998 for $100,000.

Injuries

The plaintiff suffered musculoskeletal injuries to her lower back, superimposed upon a pre-existing degenerative condition. While plaintiff was receiving treatment for her injuries, a non-alignment tumor was discovered, the existence of which significantly affected the course of plaintiff's treatment and her eventual recovery.

Result

The case settled at mediation for a total of $65,000 before Gary Fields, Esq., of Fields ADR.
