Facts

Plaintiff Lela Williams, a black woman age 50, worked as a human resource assistant for the Department of Navy in San Diego. In January 2003, she was taken from this position.

In response, Williams appealed with the Merit Systems Protection Board (MSPB), contending that she was removed because of discrimination and that this action was retaliation for her prior complaints of discrimination. In April, 2003, MSPB reversed her removal. Williams was reassigned, but she contended and complained of continued discrimination and retaliation.

She sued Donald C. Winter, Secretary of the Navy, pursuant to Title VII of the Civil Rights Act and alleged retaliation based on her previous complaints and the appeal with the MSPB.

Contentions

PLAINTIFF'S CONTENTIONS:
Willaims claimed that she was not promoted to Level 7 human resources assistant during the period of July 2004 and August 2006, as well as to Level 8 in July 2006, and that these were acts of retaliation. She further contended that failure to recognize her with a performance award in June 2005, excessive criticism of her work, untrue accusations, extra work, tampering, and poor performance appraisals constituted retaliation as well.

$150,000 (lost wages, emotional distress and attorney fees.)
