Facts

On July 12, 2005, plaintiff Debra Strout was crossing the street at the intersection of Webster and Clay Streets in San Francisco. A DPT vehicle owned by defendant city and county of San Francisco was stopped next to the crosswalk. When the vehicle suddenly began to reverse, plaintiff attempted to protect herself by throwing her arms up. Plaintiff pushed off the side of the vehicle, and fell onto the street.

Plaintiff did not obtain the DPT officer's name, and counsel was unable to locate the officer, despite extensive discovery, including depositions of officers who had been working in the area at the time of the accident.

Injuries

Plaintiff sustained a torn ligament in her right ankle, which required surgery.

Result

The case settled for $97,500.
