Facts

In 1991, defendant Anthony Camilleri, an employee of MUNI since 1973, was promoted to assistant electronic maintenance technician. At the time, MUNI's electronic farebox system had just been implemented. Defendant was later promoted to electronic maintenance technician, which required him to repair malfunctioning fareboxes and cashboxes. Defendant Tan Huynh was promoted to the same position in 2000. Defendants were required to keep a daily log duties.

In 2003, when another MUNI employee observed defendants accessing the boxes during non-working hours, MUNI investigators commenced surveillance of defendants. Defendants were seen checking fareboxes in early morning hours before the start of their shifts and on their days off. Based on these observations, MUNI reported defendants to the San Francisco Police Dept. Defendants were subsequently arrested.

Defendant Camilleri's vehicle and home were searched. Police found MUNI cashboxes and cardboard boxes containing $38,000 in cash and 8,000 MUNI tokens with a face value of $8,400. A search of defendant Huynh's property revealed $20,000 in cash and several electronic devices connected to the fareboxes.

Result

The case settled for $287,000.
