Facts

On Dec. 8, 2004, plaintiffs Amber Marie Pelfrey and Kyle German were traveling by car east of Central Avenue in Corning, California, when a horse owned by defendant Joseph Havel appeared in the middle of the lane. The plaintiffs' vehicle struck the horse and it flew into the windshield.

Contentions

PLAINTIFFS' CONTENTIONS:
Pelfrey and German contended that the horse got out of defendant's fenced-in pasture and made its way to the freeway.

Result

The jury found for the defense and the court awarded costs to defendant in the amount of $3,132.
