Defendant David John Routledge's 1991 Ford pickup truck jumped the center divider of SR-91 in Riverside, hitting plaintiff's 2002 Toyota Sienna.

PLAINTIFFS' CONTENTIONS:
The plaintiffs alleged that defendant negligently drove his vehicle causing it to lose control.

Injuries

Plaintiff Larry Neisess suffered loss of consortium. Plaintiff Paige Neisess, 9-years-old, suffered blunt abdominal trauma and grade 1 liver laceration with small contained hematoma. Plaintiff Ryan Neisess, 12-years-old, suffered blunt abdominal trauma and abrasions extending from the left side of the neck to the right hip. Plaintiff Krystyn Neisess suffered multiple abrasions and contusions, blunt trauma, and left posterior rib pain.

Result

The plaintiffs settled the case for $442,500. The award was divided in the following manner: Lyndenette Hirouji-Neisess received $250,000; Larry Neisess received $50,000; Paige Neisess received $85,000 (including $9,337 in medical expenses, $21,231 in attorney fees, and $75 in general expenses); Ryan Neisess received $42,500 (including $5,127 in medical expenses, $10,621 in attorney fees, and $16 in general expenses); Krystyn Neisess received $15,000 (including $1,997 in medical expenses, $3,741 in attorney fees, and $35 in general expenses).
