Facts
On Sept. 25, 2006, plaintiff Mezelle White went to defendant Fresh Start Chiropractic for an appointment with defendant Thomas F. Dickershaid. White was suffering from a back injury. White was met by Dickershaid, whose assistant was out of the office. Dickershaid requested that White disrobe and put on a gown in order for easier massage of the back. White disrobed to her underwear and lay face down on the table.
Contentions
PLAINTIFF'S CONTENTIONS:
White contended that when she was lying face down on the table, Dickershaid began to massage her abdomen. White attempted to leave but Dickershaid forced her back onto the table and began touching her breasts and vaginal area. Dickershaid removed his clothes and forced plaintiff to hold his penis. White escaped Dickerhaid's grasp before he could insert his penis into her vagina and was able to unlock the door and leave after quickly dressing.
Injuries
The plaintiff claimed sexual assault.
Result
The court found for the plaintiff in the amount of $500,750.
