General Counsel brought a complaint against Service Employees International Union, Local 87.

Contentions

COMPLAINANT'S CONTENTIONS:
General Counsel alleged that the Union violated Section 8(b)(1)(A) of the National Labor Relations Act by a Union agent telling employee CuiXia Rong that unless she signed a union authorization card, the Union would not help her with problems in the future.

RESPONDENT'S CONTENTIONS:
Szeto admitted that he told Rong that unless she joined the union, it would not assist her in the future.

Result

The administrative law judge found the Union violated the Act and ordered it to cease and desist from telling an employee that the Union would not help her with problems in the future unless she signed a union authorization card. The ALJ ordered the Union to cease and desist in any like or related manner restraining, or coercing employees in the exercise of the rights guaranteed them by Section 7 of the Act.
