Facts

Kyle Doe sued the Dept. of Health and Human Services, Child Protective Services, Sacramento County, Sacramento County Sheriff's Dept., and Caren Ramirez, in connection with allegations of child abuse and neglect.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff's caretaker, defendant Ramirez, allegedly abused plaintiff over a period of seven years. Several complaints were lodged against Sacramento County by teachers and others concerned about plaintiff's well-being. However, the county systematically ignored those concerns. Then, one day, plaintiff escaped Ramirez's house by jumping over a wall using a trampoline. He then made his way to a fitness center where others found the dirty and wounded teen with a chain around his ankle. Plaintiff asserted claims for negligence per se and breach of mandatory public entity duties, negligence and negligent hiring, supervision, and training, violation of federal civil rights, and negligent infliction of emotional distress.

DEFENDANTS' CONTENTIONS:
The county denied owing any duty to plaintiff, and denied any wrongdoing and any liability.

Result

The county agreed to pay the child, who is now an adult, $4 million.
