Facts

Veronica Andaya, 21, Leonel Andalis, 23, and Katrina Viray, 21 sued Andrew Cassara after Cassara rear-ended Andalis' vehicle. Andaya and Viray were passengers in Andalis' vehicle.

Contentions

PLAINTIFFS' CONTENTIONS:
Plaintiffs contended that Cassara negligently operated his vehicle.

DEFENDANT'S CONTENTIONS:
Defendant did not admit liability, but did not dispute that he was negligent in trial.

Settlement Discussions

The last demand was $13,333 on behalf of each plaintiff, $40,000 to be split three ways. Defendant made CCP Section 998 offers to Veronica Andaya for $8,030, Leonel Andalis for $7,650 and Katrina Viray for $8,100, for a total of $23,780.

Injuries

The three plaintiffs claimed soft tissue injuries and claimed continuing complaints. They all treated with a chiropractor.

Result

The jury found that Cassara was negligent and awarded plaintiffs Andaya $3,000, Andalis $2,500, and Viray $3,250, for a total of $8,750 in damages.
