Facts
Samvel and Asdghig Kasabian sued Excalibur Van Lines Inc., Excalibur Moving Company, Enterprise Rent-A-Car Company of Los Angeles, LLC and Raul Gutierrez following a collision between Asdghig Kasabian's vehicle and a truck that was driven by Gutierrez. Samvel Kasabian was driving Asdghig's vehicle at the time of the collision. The collision occurred on July 29, 2012 at the intersection of Harvey Drive and Wilson Avenue, in Glendale. Enterprise filed a cross-complaint against Excalibur.
Contentions
PLAINTIFF'S CONTENTIONS:
The Kasabians contended that Gutierrez negligently operated his vehicle and that the other defendants were liable because they owned the vehicle Gutierrez was driving.
DEFENDANT'S CONTENTIONS:
Enterprise contended that it was not liable because it did not own the vehicle Gutierrez was driving. It claimed that the vehicle had been sold to Excalibur.
Result
The court granted Enterprise's motion for summary judgment, finding no triable issue of material fact as to whether Enterprise owned the truck at the time of the accident.
