John Jacobs sued Cubic Corp. in connection with a motor vehicle accident that allegedly occurred on Feb. 4, 2014.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff was stopped near the entrance to westbound Interstate 52, when a van being driven by defendant's employee rear-ended him. Plaintiff sustained injuries as a result and sued defendant for negligence. Plaintiff claimed the driver failed to keep a proper lookout and struck him at a speed of between 25 and 35 mph.

DEFENDANT'S CONTENTIONS:
Defendant disputed the extent of plaintiff's claimed injuries and treatment.

Settlement Discussions

Jacobs demanded $199,000 in settlement, which Cubic countered with a $135,000 offer.

Injuries

Jacobs claimed injuries to his spine and underwent chiropractic treatment and injections. Jacobs claimed he would need future lumbar fusion. Jacobs also claimed his injuries limited his ability to enjoy activities like kayaking and other sport. He also claimed it would shorten his career as a tree trimmer.

Result

The jury found in favor of Jacobs and awarded him $1,086,839, including $66,839 in past medical expenses, $200,000 in future medical expenses, $5,000 in past lost earnings, $207,500 in future lost earnings, $75,000 in past non-economic loss, and $532,500 in future non-economic loss.
