Lisa Capocci, a 33-year-old female, was employed as a patrol officer for the Concord Police Department for four and one-half years. She resigned from her job in July 2010, claiming an intolerable work environment.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that her supervisor made improper sexual advances toward her. Further, she claimed that she suffered retaliation when she complained about the conduct, consisting of unfounded internal affairs investigations against her. She also contended that other officers took too long to back her up when she was called to duty.
DEFENDANT'S CONTENTIONS:
Defendant argued that the Concord Police Department treated plaintiff fairly in all respects. Defendant asserted that it investigated Ms. Capocci's harassment and retaliation complaints, concluding that they were unfounded. Further, defendant alleged that plaintiff's job performance was deficient, and that her fellow officers provided her with timely and effective backup in the field.
Result
After the third day of jury trial, the parties reached a settlement totaling $750,000, of which $500,000 was attorney fees.
