Facts
A class of persons employed by RadioShack in California between June 3, 2003 and the present, who operated their personal vehicles when traveling to and from RadioShack locations to undertake inter-company transfers, filed an action against RadioShack.
Contentions
PLAINTIFFS' CONTENTIONS:
Plaintiffs claimed that defendant had illegally refused to pay employees for costs incurred when using their personal vehicles to undertake the transfers. They argued that they were entitled to reimbursement according to California Labor Code Section 2802 and the California Business & Professions Code. They also argued that defendant owed them penalties pursuant to the California Labor Code Private Attorney General Act.
Damages
Plaintiffs sought $1.5 million and $78,436.69 in litigation costs.
Result
The parties reached a settlement amounting to $4.5 million, which consisted of $1.5 million in fees and $5,000 in incentive payments to lead plaintiffs. Each class member's award is dependent on the quantity of weeks worked. Following deductions, the amount available to the class totaled $2,796,563.31.
