Plaintiff minor, through her guardian ad litem Karine Brookshire, sued defendants Community Memorial Hospital of San Buenaventura (CMH), plastic suegeon Samuel A. Bern M.D., and anesthesiologist Robert Watson M.D. for a botched surgery on the minor. The surgery was to remove a suspicious-appearing nevus from plaintiff's right cheek.

Result

The jury found defendant Watson 5 percent at fault, Bern 80 percent at fault, and CMH 15 percent at fault. Plaintiff was awarded $10,000 for past economic loss; $1,125 for past medicals; $10,000 for future economic loss; $23,750 for future medical expenses; $70,000 for past non-economic loss; and $50,000 for future non-economic loss against defendant Watson.
