Respondent insurance company conceded that deceased had not been notified of ceasing of accidental death coverage with age 70. Insurance company paid policy limits for accidental death of 84-year-old based upon medical records and affidavits of family and caregiver witnesses, despite contraindications in death certificate, upon which insurance company sought to rely.

Result

The insurance company paid $128,136 policy limits. There was no waiver of future liability.
