Plaintiff Lina Tarverdian was walking near 1638 South Central Avenue in Glendale on March 9, 2005, when she tripped and fell due to small holes/chips in the concrete sidewalk that she was walking along.

Contentions

PLAINTIFF'S CONTENTIONS:
Tarverdian claimed that the sidewalk should have been maintained by Defendant city of Glendale and that it was tantamount to a hazard on public property.

DEFENDANT'S CONTENTIONS:
The city of Glendale argued several points in its defense. First, the defendant claimed that the hole was only 2 inches wide and about a half an inch deep. Second, the allegedly dangerous sidewalk was situated where the plaintiff had worked for a long period of time. Next, the accident occurred in the evening when the sidewalk was illuminated by streetlights as well as lighting from nearby buildings. Furthermore, there had not been any other complaints, incidents or physical damage for 10 years prior to the plaintiff's accident.

The plaintiff asserted that she should be awarded damages in the form of loss of earnings and future earning capacity.

Injuries

The plaintiff claimed that she suffered injuries to her left ankle and knee, hands, and soft tissue. She also alleged that as a result of her injuries she could not move and thus became ill from pneumonia.
