Facts

PNY Technologies sued its rival flash memory manufacturer, SanDisk Corp., for violating the Sherman Act, alleging monopolization in demanding multi-tiered licensing and royalties in the downstream market, which suppressed price competition in the States.

SanDisk filed a motion to dismiss all five claims for failure to state a claim under Rule 12(b)(6) of the Federal Rules of Civil Procedure.

Result

The court granted SanDisk's motion to dismiss.
