Facts

On Nov. 22, 2004, plaintiff Angelica Pascual was driving a 2002 Dodge Durango south on San Juan Avenue in Sacramento in the first lane when she was hit by defendant Frederick Bunch, who was pulling out of a private driveway at 5349 San Juan Avenue in a Dodge 1500 pickup truck. The plaintiff sued the defendant for motor vehicle negligence.

Contentions

PLAINTIFF'S CONTENTIONS:
The plaintiff contended that the defendant negligently operated his vehicle, causing the collision.

DEFENDANT'S CONTENTIONS:
The defendant contended that the plaintiff was at fault for the accident and did not suffer injuries requiring chiropractic care.
