Facts

On April 3, 2006, at 7:20 a.m., plaintiff Frances Fattohi, a 51-year-old health insurance clerk, was traveling in her 2005 Chrysler Pacific, westbound on Riverside Freeway, SR 91 in Anaheim. Fattohi was stopped for traffic in front of her in the number two lane. She was struck from behind by a 2000 Land Rover driven by Kenneth Leddon (impact number one). This first impact propelled Fattohi's vehicle forward where she crashed into the rear of a Chevrolet Suburban (impact number two).

Fattohi was then struck a third time. This impact occurred from behind when Jack Wang crashed into Kenneth Leddon's vehicle sending it into her (impact number three).

As a result of this incident, Fattohi sustained severe and substantial injuries. Her vehicle was rendered a total loss.

Contentions

PLAINTIFF'S CONTENTIONS:
The plaintiff claimed her injuries were caused by the accident.

Injuries

Frances Fattohi suffered chest, right leg, neck and back pain, headaches, right side hematoma, subcutaneous hematoma of right knee and right leg radiculopathy. She was hospitalized for 11 days following the incident. She was monitored for hyper-compartmental syndrome and could not walk. She suffered hypotension, dizziness and occasional brady arrhythmias. She continues to experience neck and leg pain, leg numbness and swelling. She walks with the assistance of a cane. She incurred approximately, $23,000 in paid medical expenses.

Result

$100,000 policy limits demand tendered from defendant Leddon; $15,000 policy limits demand tendered from defendant Wang.
