Facts
On Nov. 12, 2007 at 7 a.m., plaintiff Douglas Miller, 60, was crossing the intersection of 4th Street and Termino Avenue in Long Beach when defendant Nolan Leal struck him with his vehicle while making a left turn. The defendant stopped 25 feet past the intersection and returned to help plaintiff. The plaintiff sought to settle his claim for motor vehicle negligence against defendant, who admitted liability.
Damages
Plaintiff's medical insurance provider paid his $354,000 medical costs. Ingenix for United Health: Subrogation Lien waived pursuant to Make Whole Doctrine.
Injuries
The plaintiff suffered from multiple injuries, including amnesia; intracranial bleeding; internal hemorrhaging; dislocated knee; fracture of the fibula; and tremors. He was hospitalized, required arthroscopic knee surgery, and underwent physical therapy upon his release.
Result
The parties settled for $250,000, defendant's policy limit.
