On Oct. 26, 2005, at approximately 4 p.m., plaintiff Richard Darvish was driving a 2003 Volkswagen Passat station wagon, eastbound on Third Street near Gardner Street, in the city of Los Angeles when defendant Sidarth Ahuja rear-ended the plaintiff's vehicle.

PLAINTIFF'S CONTENTIONS:
The plaintiff contended that defendant was negligent pursuant to Vehicle Code Section 21703 for following plaintiff's vehicle too closely.
DEFENDANT'S CONTENTIONS:
The defendant contended that plaintiff came to a "sudden stop."

Damages
The plaintiff claimed he sustained a 4 mm disc herniation in his cervical spine. Defendant's expert, Dr. Stephen Rothman opined that the MRI did not show a cervical disc herniation. Plaintiff's expert, Brian King, M.D., confirmed that a 4 mm disc herniation did in fact exist.
Result
The case settled with Alan Saler, Esq. for $390,000.
