On Dec. 6, 1997, plaintiff, a 55-year-old marketing executive, was struck by a vehicle driven by defendant as he attempted to cross a street via the crosswalk. The accident occurred at the intersection of Rodeo Drive and South Santa Monica Boulevard in Beverly Hills. This intersection is controlled by traffic signals including pedestrian control signals.
