Facts

Dolores Press Inc. filed an infringement lawsuit against Patrick Robinson, Truth Seekers Inc., and Doc's Dream LLC, in connection with Dr. Gene Scott's teachings and intellectual property rights.

Contentions

PLAINTIFF'S CONTENTIONS:
Dr. Scott was a pastor that was highly influential and beloved by his ministry. When he passed, he allegedly left all his rights, including intellectual property rights, to his wife, Melissa Scott, who was also a pastor. Defendants allegedly began displaying Dr. Scott's teachings and illegal copies of his sermons online, infringing on plaintiff's copyright and trademark rights.

DEFENDANTS' CONTENTIONS:
Defendants moved to dismiss for failure to state a claim for relief. Alternatively, defendants argued the complaint should be dismissed pursuant to the first-to-file rule.

Result

The court granted defendants' dismissal motion.
