Plaintiff brought a medical malpractice action against defendants.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that he went to Dr. Aram Mkhitarian at Warner Plaza Urgent Care for treatment, and was diagnosed with influenza. He claimed that he suffered and continued to suffer blindness after consuming Bactrim, which Mkhitarian had prescribed him. Mkhitarian committed medical negligence by prescribing plaintiff Bactrim without informing him that blindness was a side effect, and Warner Plaza was vicariously liable for Mkhitarian's actions.

DEFENDANTS' CONTENTIONS:
Defendants argued in their motion for summary judgment that plaintiff's complaint was without merit because Mkhitarian complied with the required standard of care.

Result

The court granted defendants' unopposed motion.
