Facts

Plaintiff Jane Doe, a stroke-disabled woman, was raped numerous times by a now imprisoned, ex-Sacramento beat cop, Gary Dale Baker. Plaintiff was in her mid-70s and had suffered a stroke that robbed her of much of her ability to speak. Plaintiff related the attacks to her family members on Thanksgiving 2010, a year after she'd suffered the stroke.

At the criminal trial, family members testified that plaintiff called out "rape," and "police," and pantomimed acts she said she was forced to perform. Various forensics experts and medical professionals testified that physical examinations and crime kit analysis revealed evidence of trauma and bodily fluids. The former officer admitted to performing sex acts with plaintiff at the criminal trial.

Plaintiff had known the officer for years before the attacks occurred.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that the officer was on-duty at the time of the attacks.

DEFENDANT'S CONTENTIONS:
The city contended that the evidence, including GPS data, employment data, and witness testimony, proved that the officer was not on duty at the time of the attacks. Since plaintiff knew the officer before the attacks, the issue was uncertain.

Injuries

Plaintiff suffered physical harm from the trauma as well as emotional and psychological harm as the result of the multiple sexual assaults.

Result

The case settled for $1.35 million from the City of Sacramento and the apartment complex where the rapes took place. The settlement was split between the two defendants.

Other Information

The former Sacramento Police Officer was sentenced to 62 years to life in prison in November 2015 after being convicted on nine out of ten counts of rape, forcible oral copulation, assault with intent to commit rape and burglary.
