Facts

Federal Trade Commission sued CD Capital Investments LLC, CD Capital LLC, GDS Information Services Inc., Christian Quezada, individually and as an officer of CD Capital and CD Capital, Tuan Duong, individually and as an officer of CD Capital, CD Capital and GDS, Gabriel Stewart, individually and as an officer of GDS, in connection with an allegedly fraudulent mortgage relief scheme.

Contentions

PLAINTIFF'S CONTENTIONS:
Defendants allegedly operated businesses under the names "2Apply" and "UW Solutions" and scammed distressed homeowners by offering foreclosure prevention services and offering to lower interest rates and mortgage payments. In so doing, defendants allegedly violated the FTC Act and the Mortgage Assistant Relief Services Rule.

Result

The district court issued a permanent injunction against defendants, enjoining them from making material representations about financial or other services. The court also imposed more than $1.7 million in judgment against defendants. Additionally, the court entered summary judgment against Duong.
