Plaintiff, 8, was a special education student enrolled in the Center Joint Unified School District, in Sacramento County. Plaintiff filed suit against the district and several district employees.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended that she was subjected to bullying and sexually assaulted by a peer. Defendants failed to supervise the students and failed to ensure plaintiff's safety at school. She asserted causes of action in her second amended complaint for violation of Title IX (20 U.S.C. section 1681 et seq.), negligence, negligent infliction of emotional distress, and dangerous condition of public property.
DEFENDANT'S CONTENTIONS:
The District denied plaintiff's allegations and asserted various affirmative defenses.
Result
Plaintiff settled with defendants for $165,000.
