Inmate Phillip Wright filed a habeas petition against Connie Gibson for alleged constitutional rights violations.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff was a patient in a state hospital when he allegedly attacked a staff member. Plaintiff asserted a sanity defense, but the prosecution asserted he was sane based on the invocation of his Miranda rights by exercising his right to be silent and asking for an attorney. The jury rejected his insanity defense and ultimately convicted him of the crimes. Plaintiff then filed this instant petition for habeas relief, alleging improper references to his invocation of Miranda rights during the sanity phase of his trial, ineffective assistance of counsel, and sentencing error under the Three Strikes Law.
DEFENDANT'S CONTENTIONS:
Defendant contended that plaintiff's claims were barred and had been reasonably rejected by the state court. Overall, defendant claimed that the action should be dismissed.
Result
The magistrate judge recommended the denial of Wright's petition and dismissal of the action with prejudice. The district court subsequently adopted the judge's report and recommendation and dismissed the petition accordingly.
