Inland Empire Waterkeeper and Orange County Coastkeeper sued Robertson's Ready Mix Ltd., in connection with an environmental dispute.
Contentions
PLAINTIFFS' CONTENTIONS:
Defendant allegedly operated concrete, sand, and gravel storage and delivery facilities in Riverside, Rialto, Santa Ana, and other places in Southern California. Defendant allegedly discharged pollutants without obtaining the proper permits and in violation of the Storm Water Permit and the Clean Water Act and other environmental laws. The discharges allegedly polluted the Newport Bay watershed and impaired plaintiff's members' use and enjoyment of those waters.
DEFENDANT'S CONTENTIONS:
Defendant denied the allegations and asserted various defenses.
Result
The parties entered into a consent decree. As part of the agreement, Robertson's agreed to comply with the permitting requirements and the applicable provisions of the Clean Water Act relating to its operation of the facilities.
