Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended that defendant negligently operated his vehicle.
DEFENDANT'S CONTENTIONS:
Defendant admitted fault but contested plaintiff's injuries, arguing that plaintiff's injuries were degenerative in nature and exacerbated by his uncontrolled diabetes.
Settlement Discussions
The insurance company for the defense rejected a policy limit demand of $50,000, according to plaintiff.
Injuries
Plaintiff claimed he suffered a torn rotator cuff in his right shoulder and herniated lumbar discs that caused radiculopathy into this lower extremities. He claimed his injuries prevented him from returning to work as a truck driver.
Result
The jury found defendant's negligence was a substantial factor in causing plaintiff's harm, awarding him $1,132,336.31 in damages.
