Plaintiff brought a class action complaint against Gucci America Inc. for violations of California Civil Code section 1747.08, the Song-Beverly Credit Card Act.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended that defendants violated the Act by implementing a policy at its retail stores during point of sale credit card transactions in which cashiers requested and recorded consumers' personal identification information, such as mailing addresses, telephone numbers and email addresses.
DEFENDANT'S CONTENTIONS:
Gucci denied plaintiff's allegations.
Result
Pursuant to the settlement reached between the parties, eligible class members will receive a voucher redeemable for a 15 percent discount at eligible Gucci stores, valid for full priced merchandise worth up to $10,000. Alternatively, the voucher may be redeemed for one gift worth between $40 and $120, subject to Gucci's choosing.
