From 2002 to 2008, Plaintiff's assignor, CDR Graphics Inc. (CDR) rendered blueprint duplication services on behalf of defendant Stephen Mark Albert, individually and dba The Albert Group Architects aka TAG ("Albert"). After credits, Albert owed CDR $48,453 for said services.
When Albert refused to pay CDR the $48,453 principal balance due, CDR assigned its claims to plaintiff Attorney Recovery Systems Inc. (ARS), a collection agency.
On July 13, 2011, ARS filed a complaint against Albert alleging common counts seeking the $48,453 claimed due.
Contentions
PLAINTIFF'S CONTENTIONS:
ARS claimed that the price given to Albert by CDR was already discounted and that the principal sum of $48,453 was due by Albert.
DEFENDANT'S CONTENTIONS:
Albert claimed that CDR promised Albert a 25 percent discount on all business and when said discount was applied to the principal balance due only $8,131 was due to CDR.
Settlement Discussions
Mediation was held before Ronald Friedman, Esq. ARS demanded $50,000 stipulated judgment. Defendant offered payment of $1,000 per month.
Result
$69,545 (including $21,092 per plaintiff's Memorandum of Costs awarded to Attorney Recovery Systems Inc. against Stephen Mark Albert, individually and dba The Albert Group Architects aka TAG).
