Facts

On Dec. 22, 2009, about 700,000 gallons of water from the Long Ranch water tank cascaded downhill into three houses. A software update had malfunctioned and failed to trigger alarms that water levels were reaching critical levels in the 5-million gallon tank before it overflowed. The water overflowed from V-shaped ditches running parallel to the homes. Robert and Malgorzate Wiatr were the owners of one of the homes that was flooded. The Wiatrs sued the city for damages.

Result

The parties settled for $18,500.
