Christine Petersen filed a complaint against the City and County of San Francisco, City of Berkeley, and private property owners (Diaz), seeking monetary damages, including general damages, and past and future medical expenses for alleged premises liability.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that on Dec. 23, 2008, defendant San Francisco negligently maintained, failed to inspect, and failed to place warnings at a sidewalk in San Francisco, and thus, caused a dangerous condition of public property in which a plywood board covered the sidewalk and protruded upward from the pavement. Plaintiff claimed that defendant knew of or should have known that the condition created a hazard. Plaintiff alleged that such negligence caused her to fall, resulting in a fracture of the right wrist.
Result
The parties settled for $98,395, consisting of the following: City of San Francisco, $34,000; City of Berkeley, $56,000; Diaz defendants, $5,000 (medical payments); and waiver by San Francisco of SF General Hospital medical lien, $3,395.
