Facts

Lazare Kaplan International Inc. (LKI) sued Photoscribe Technologies Inc. and Gemological Institute of America (GIA) for patent infringement for diamond inscription machines. The Court found that the patent claims were valid, but were not infringed by Defendants. Final judgment was entered against LKI following jury and bench trials. LKI appealed, prompting Defendants to file a motion for relief from the prior judgment of validity of the patent claims as well as a motion for summary judgment.

Result

Defendants' motions for relief and summary judgment were granted.
